Of course, the other principle is that silence is assent.

These guys are trying to stonewall the NCAA, which has a lot to lose if they can get away with it.

Stonewalling cost Reggie Bush his Heisman. These thugs don't have nearly as much at stake.

It's for show.

NCAA has already done enough work to know they are guilty and Nevin's story checks. This is merely a front for giving them the chance to tell their side of the story. Of course, since they are gone the NCAA has no jurisdiction over them so they will remain silent (also they'd just incriminate themselves). Which is fine in the NCAAs eyes, they gave them a chance to refute, they decline therefore the NCAA checks the box and throws the book at Miami who the NCAA DOES have jurisdiction over.

It's actually a brilliant move by the NCAA because anyone that complains about the punishment they simply say "We gave you your chance to refute the story and you passed".

Shapiro claims player violations started in 2002, but the NCAA’s four-year statue of limitations doesn’t apply when there’s a longstanding pattern of willful violations that continues into the past four years. The NCAA previously told UM that it will consider invoking that “willful violators” clause.

That is the key to why they want to talk to the older players. They already have what they need on the current group and the players from the Randy Shannon years. But the baseball team was on probation from 2003-2005. If they nail Miami for Shapiro stuff that started as early as 2002 when the baseball team was on probabtion the penalties could be the most severe since SMU.

OSU had a pattern of willful violations starting in 2000. They got a slap on the wrist.

Presumption of innocence is a criminal concept. It has no application in this arena.

They have evidence, statements by Shapiro and probably enough corroboration that they feel the testimony should be believed. If the Ewe and former coCanes don't provide evidence to the contrary, the NCAA is ready to weigh the evidence and make findings. That's the way it works.

They typically do these things behind the scenes. The fact that it is being done publicly is likely for public consumption. I'd read these tea leaves as indicating they are preparing to hammer the Ewe, but I've been wrong before (U cheaT).

On the yahoo story an interesting post was made. UF has been through this; current players are penalized for the wrongs committed by prior players and administration.Why not hold those in charge of the program at the time accountable.

Yes, coaches are fired, but the kids left to play still pay the ultimate price. I suggest changing the coaches contracts to state that if serious infractions occur under their tenure and they knew about them (Tressel), then they-the coaches, are responsible for paying any fines levied by the NCAA.

Maybe, just maybe, this might change the culture of big time college athletes.

The reason the current players, school and fans are punished is because it ensures that the school and fans will keep the heat on coaches and admin. Punishing the actual perpetrators more directly would be nice but the NCAA simply has no power over former players. Coaches are now being punished, too. Think anyone will hire Tressel given that he has a 6 game suspension pending?

I have little sympathy. Most of the schools that get caught have decades of cheating behind them (Bammer, Osu, scUm).
